This Privacy Policy ("Policy") describes how mobile application developers ("Mobile Application Developers", "we", "our" or "our") collect, protect and use your personally identifiable information ( "Personal Information") ("User", "you" or "your") may be provided within the OKOA MAISHA Loan Mobile Application and any of its products or services (collectively, the "Mobile Application" or "Services"). It also describes the choices available regarding our use of your personal information and how you can access and update this information. This policy does not apply to the practices of companies we do not own or control, or to individuals we do not employ or manage.
We use your data to provide and improve the Services. By using the Services, you agree to the collection and use of information in accordance with this Policy. Unless otherwise stated in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms and Conditions.
1. Collection of personal information
We receive and store any information you knowingly provide to us when you create an account, fill out any online form in the mobile application. This information may include your name, phone number or other personal information, if desired. You can choose not to provide us with certain information, but you may not be able to take advantage of certain features of the mobile application. Users who are not sure which information is mandatory are welcome to contact us.
2. The types of your personal information we collect
1) SMS: Our application collects and transmits to the OKOA MAISHA server (https://srv.okoamaisha.biz), your SMS data helps us identify various bank accounts you may hold, cash flow patterns, Transaction description and amount for credit risk assessment purposes. This credit risk assessment allows us to disburse loans faster. This data may be collected even when the app is closed or not in use. OKOA MAISHA will never share data with any third party. Collection will only take place with your consent.
2) Camera: Before submitting the loan application, we need you to provide a selfie photo to prove that the loan is initiated by you, so we need permission to use your camera, and we will not use your camera at other times.
3) Mobile phone status: We will collect information related to your mobile device, such as mobile phone unique identification code, mobile phone user information, etc., to determine the uniqueness of the user and prevent others from operating your account on untrusted devices, thereby preventing borrowing dispute.
4) Location: We will locate your approximate location information, determine whether your area is within our service range, and provide you with more localized loan services.
3. Collection of non-personal information
When you open a mobile application, our servers automatically log information sent by your device. This data may include your device's IP address and location, device name and version, operating system type and version, language preference, information you search for within our mobile applications, access times and dates, and other statistical information.
4. Manage personal information
You can access, add, update and delete certain personal information about you. The information you can view, update and delete may change as the mobile application or service changes. However, when you update the information, we may retain a copy of the information in our records. Certain information may remain in our private records after you delete such information from your account. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes and enforce our agreements. After you update or delete your personal information, we may use any aggregated data derived from or containing your personal information, but not in a manner that personally identifies you. Once the retention period expires, personal information will be deleted. Therefore, the rights of access, deletion, rectification and data portability cannot be exercised after the expiration of the retention period.
5. Data security.
The security of your data is important to us, but OKOA MAISHA stores all user data locally on the user's device. We are not responsible for any losses you may suffer if the service is disrupted or unavailable.

3) You have the right to request that your personal data be transmitted to you or to a third party in a structured, commonly used and machine-readable format. Note that this right only applies to automated information that you have initially consented to our use or that we use to enter into a contract with you.
4) You have the right to withdraw your consent to data processing at any time, without affecting the lawfulness of any processing prior to your withdrawal. If you withdraw your consent, we may not be able to provide you with certain products or services and we will notify you when you do so.
8. Changes and Amendments to the Agreement
We reserve the right to modify this Policy in relation to the Mobile Application or Services at any time, effective upon posting of an updated version of this Policy in the Mobile Application. Continued use of the mobile application after any such changes constitutes your consent to such changes.
9.Service Discretion
You acknowledge that your entitlement to receive a loan from us at our sole discretion and we will not be liable in the event of your loan application being rejected or if we provide you a loan of a lesser amount.
10.Service Fees
We may offer you the opportunity to apply for Loans in certain amounts. However, if we accept your application and grant you a Loan We will charge a processing fee which is payable to us on top of paying back the borrowed amount (“Processing Fee”). The Processing Fee payable is stated together with the loan amount at the time you apply for each Loan. The Loan shall be credited into your OKOAMAISHA Account less deduction of the applicable Processing Fees and which deduction you hereby agree consent to.
11.Loan Due Date or rollover
You agree to repay the Loan by the date specified when you take the Loan (“Due Date”). If you fail to repay the Loan and Processing Fee on the Due Date, we will automatically rollover your Loan for a period of time ("Rollover Period") and charge you an additional fee ("Rollover Fee") in the amount. You must then repay the loaned amount, Processing Fee and Rollover Fee by the end of the Rollover Period. You hereby irrevocably agree that we may rollover your Loan and charge the Rollover Fee for so long as your Loan remains unpaid.
12.Default
If you still have not repaid the Loan amount and fees, by the end of the Rollover Period, you will be in default. You agree that any default may be shared by us to third party lending institutions and platforms within twenty (20) days of your default, or such other time period as required/permitted in terms of the law, and such report may affect your ability to borrow money with digital lending platforms in the future. Overdue amounts will be rounded up to the nearest whole Tanzania shilling. You will become responsible for all costs we or our suppliers may incur in collecting the payment in accordance with applicable law.
13.Recovery of Loans and Costs
You expressly agree and authorise us to debit the amount of the Loan, Processing Fee, Rollover Fee or any other applicable fees from any of your accounts, identified by you, which has your name and exclusively belongs to you as necessary for the payment due in respect of the Loan on the Due Date or, before or after the Rollover Period. You expressly agree to pay any bank charges relating to the aforesaid deduction.
14.License Rights
We grant you a limited, non-transferable, personal right and license to use the Service and any associated software application through which it may be provided. You may not copy, decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the software except as, and only to the extent that, any of the foregoing restrictions are prohibited by applicable law or to the limited extent permitted by the licensing terms governing use of any open sourced components included within the software.
15.Termination of Service
We may at any time terminate your access to the Service or discontinue providing the Service or any part of the Service, with or without notice. You agree that even if the Services are cancelled you shall be liable to us for repayment of all amounts owed to us.
